Благодаря новой кадастровой оценке подмосковной недвижимости, которая проходила в этом году, налоговая нагрузка снизится для 2,5 миллиона граждан — об этом на днях сообщил заместитель председателя правительства Московской области – министр экологии и природопользования региона Дмитрий Куракин.

С января 2018 года в регионе проводилась кадастровая оценка объектов недвижимости. В среднем стоимость объектов недвижимости не увеличилась, а по отдельным группам она даже снизилась.

«Отмечено снижение до 20% кадастровой стоимости на земельные участки для индивидуального жилищного строительства, личного подсобного хозяйства, садоводства, дачного хозяйства граждан преимущественно на удаленных от МКАД территориях», — сообщил журналистам во вторник в Доме подмосковного правительства заместитель председателя правительства Московской области – министр экологии и природопользования региона Дмитрий Куракин.

В Подмосковье уделяется особое внимание кадастровой оценке недвижимости. Тем более что проблема определения справедливой, экономически обоснованной кадастровой стоимости поднята на уровень Президента РФ, который в своем Послании Федеральному собранию Российской Федерации 1 марта 2018 года дал точное указание — принять меры по совершенствованию законодательства, чтобы не допустить в налогообложении кадастровой стоимости выше рыночной.

В Московской области на протяжении ряда лет ведется работа по анализу и исправлению завышенной кадастровой стоимости без судов и оспаривания в комиссиях — достаточно обращения в минимущество. Таким образом, удалось исправить кадастровую стоимость более 170 тыс. объектов недвижимости.

14 сентября 2018 года в фонде данных Росреестра, на сайте ГБУ МО «Центр кадастровой оценки» и на региональном портале госуслуг были опубликованы предварительные результаты новой кадастровой оценки подмосковных объектов недвижимости для публичного обсуждения, которое продлится до 2 ноября 2018 года. Там же любой собственник, не согласный с данными кадастровой оценки, может подать свои обоснованные замечания.

На сегодняшний день в областное минимущество поступило чуть более 2 тысяч обращений. Из них рассмотрено 1200. И только 300 из них признаны объективными и будут исправлены. «Учитывая, что в Подмосковье 12,3 млн объектов недвижимости, — это капля в море», — говорит Дмитрий Куракин.

«Кадастровая оценка не может быть плохой или хорошей. Методика массовой оценки дает погрешности. В 2013 и в 2015 годах коллеги неплохо сделали оценку, количество жалоб было менее 2%. Сбалансировать погрешности позволяет механизм апелляции. В Московской области впервые в России был внедрен опыт изменения кадастровой стоимости объектов без оспаривания в суде и комиссиях. Таким образом была скорректирована кадастровая стоимость по 170 тыс. объектов», — пояснил Куракин.

По его словам, новая кадастровая оценка проводилась с учетом полученного опыта и практики применения кадастровых оценок 2013 и 2015 годов. Были изучены результаты и выявлены причины завышения или занижения кадастровой стоимости, а также все случаи оспаривания. Кроме того, установлены новые факторы, влияющие на ценообразование, например, такие, как близость аэропортов, появление новых дорожных развязок, газификация населенных пунктов.

Кадастровая оценка объектов недвижимости должна проводиться не чаще чем раз в три года, но и не реже чем раз в пять лет. По данным областного минимущества, предыдущая кадастровая оценка дала порядка 44 млрд рублей в консолидированный бюджет Московской области.

«Мы прогнозируем, что налоговые поступления от объектов капитального строительства увеличатся на 1,3 млрд рублей, доходы от земельного налога уменьшатся на 1 млрд рублей. Общий рост налога на недвижимость составит 0,3 млрд рублей. Однако данное увеличение произойдет не за счет роста кадастровой стоимости объектов, а за счет появления новых объектов оценки, преимущественно торгового назначения», — сказал зампред правительства.

ЭТО ВАЖНО!

После завершения публичных обсуждений новая кадастровая стоимость будет утверждена не позднее 30.11.2018 и вступит в силу с 01.01.2019. Юридические лица уплачивают налог с новой кадастровой стоимости с 01.01.2019, физические лица начнут уплачивать налог в 2020 году за 2019-й по налоговым квитанциям.

Если неточности будут выявлены после утверждения кадастровой стоимости, их также не поздно исправить. Для этого собственник должен подать обращение в «Центр кадастровой оценки» для рассмотрения и проведения проверки. В случае, если факт ошибки подтвердится, то стоимость объекта недвижимости будет пересчитана, минимущество Московской области внесет изменения в распоряжение об утверждении результатов кадастровой оценки. Исправленная кадастровая стоимость для налога будет применяться с той даты, когда такая ошибка была допущена (ретроспективно).

✔ безопасность: огороженная территория, видеонаблюдение по периметру, КПП на въезде, круглосуточная охрана.

По постановлению Правительства РФ с 2017 года пенсионеры освобождены от уплаты земельного налога на земельный участок площадью 6 соток и уплаты налога на имущество на один объект одного типа. Кроме того, для всех налогоплательщиков рост налога на объекты капитального строительства начиная с 2018 года за 2017 год не должен превышать 10% вне зависимости от кадастровой стоимости и налоговой ставки. В Московской области введены дополнительные льготы — на 50 и более процентов освобождены от земельного налога многодетные и малоимущие семьи.
