В профильном комитете российского парламента на рассмотрении находится пакет поправок в действующее законодательство по ЖКХ. Зампред Комитета Госдумы по жилищной политике и ЖКХ Павел Качкаев рассказал «АиФ», какие изменения готовятся.
Право вето собственников
Павел Качкаев: Я бы условно разделил поправки на два блока. К первому отнёс бы изменения, которые позволят гражданам добиться от управляющих организаций (УО) добросовестной работы, а также устранят с рынка недобросовестные организации. Второй блок коснётся решения проблем, возникающих у честно работающих УО.
Например, органам Госжилнадзора будет позволительно исключать из реестра лицензий сведения об одном доме или всех домах, где работает УО, если она препятствовала или уклонялась от проверок, назначенных по жалобам граждан. Правда, в том случае, когда за год эта УО трижды получала административное наказание по решению суда.
Могут, конечно, найтись нечистые на руку сотрудники госжилинспекций и вступить с кем-то в сговор, чтобы устранить какую-то УО с рынка. Чтобы исключить такие случаи, собственникам даётся право вето: если на общем собрании они примут решение в поддержку УО, она продолжит работать в их доме.

— Если организацией нарушены лицензионные требования: нет регистрации в качестве юрлица или руководитель не зарегистрирован как индивидуальный предприниматель, не имеет квалификационного аттестата или у него есть судимость. А также если УО значится в реестре аннулированных лицензий или если в течение года со дня назначения наказания за грубое нарушение лицензионных требований она снова их нарушила.

— Получается, что для нерадивых УО жизнь усложнится, а для добросовестных станет легче?
— Да, и изменений, направленных на это, несколько. К примеру, сейчас любые решения общего собрания обязательны к исполнению. И собственники вынуждены бежать в прокуратуру по фактам фальсификаций протоколов, в судах признавать решения недействительными, а УО — принимать к исполнению решения, противоречащие нормам ГК РФ.
Согласно поправкам, решение общего собрания собственников не будет иметь законной силы, если принято по вопросу, не включённому в повестку или не относящемуся к компетенции собрания, а также если не было кворума.
Исключается возможность для потребителей не платить за коммунальные услуги, если информация о размере платы не размещена в ГИС ЖКХ. Исключается и приоритет информации в этой системе перед той, что содержится на бумажном платёжном документе.
Ещё одно нововведение: УО, ТСЖ, ЖСК не могут отказаться от заключения договоров с ресурсоснабжающими организациями на поставку ресурсов на общедомовые нужды. И самое главное — управляющая организация сможет сэкономленные при выполнении работ средства оставить себе, но при условии, что экономия достигнута не за счёт качества.

— В их пользу вводятся штрафы за нарушение порядка расчёта платы за жилищно-коммунальные услуги и предусматривается порядок их применения.
А недавно в рамках проекта «Единой России» «Управдом» мы провели мониторинг по регионам с целью выявления так называемых пустых УО, которые создаются действующими компаниями «про запас»: чтобы, если лишатся своих лицензий, сразу же начать работу под другим названием, продолжая нарушать законодательство. Если наши поправки примут, то УО, не приступившие к работе в течение 6 месяцев, будут лишены лицензий.
