О том, появится ли электронная площадка, где жители смогут обсуждать вопросы, связанные с управлением домом, мы спросили председателя Комиссии Общественной палаты Москвы по ЖКХ, капитальному ремонту и вопросам местного самоуправления Александра Козлова.
Не могут собраться
— В Общественной палате накопилось большое количество обращений, даже жалоб от представителей почти тысячи домов. Они пишут, что месяцами и годами не могут организовать собрания собственников и принять те или иные решения, — рассказал он. — Не только по таким глобальным вопросам, как капремонт, но и более простым: какие деревья посадить во дворе, установить ли новые качели и др. Решения не принимаются, и на состоянии дома, его обслуживании, на территории вокруг него это сказывается не лучшим образом.
«АиФ»: По каким ещё вопросам требуется голосование?
— Жители столкнулись с проблемой организации собраний и при реализации программы капремонта, когда выбирали между спецсчётом или так называемым общим котлом. Программа реновации тоже потребовала сделать выбор: войти или не войти в неё. Многие знают, что организовать, провести, а потом и подвести результаты общего собрания собственников — колоссальная, трудо- и времязатратная работа.
Вот почему мы обсуждаем эту инициативу. И хотим выйти с предложением к парламентариям — дополнить существующие форматы и закрепить в законодательстве электронное голосование при проведении общих собраний в очно-заочной форме. Кстати, в некоторых домах уже активно используют электронный формат при оповещении людей о собрании, а вот при голосовании его использовать нельзя. Это пока не в правовом поле.
Сберечь время
— Что делает Общественная палата, чтобы узаконить этот формат?
— Собираем мнения жителей, проводим встречи, «круглые столы» с ними, а также с представителями советов домов, ТСЖ, управляющими компаниями. Выясняем, как легитимизировать процесс. Есть предложения: информационную платформу для собраний создать либо на сайте госуслуг, либо отдельную. Необходимо проработать вопрос с представителями IT-индустрии.
— Какие проблемы активисты считают самыми важными?
— Не только собственники, но и ответственные управляющие организации говорят: собственники заняты и не приходят на собрания. Нужен кворум 50%, а собираются от силы 15%. Кто-то просто не реагирует на объявления, а потратиться на уведомительные письма каждому не везде могут. Если вы хотите делегировать кому-то свой голос, необходимо оформить доверенность — опять же трата столь драгоценного времени.
— Что могли бы обсуждать жители на электронной площадке?
— В некоторых домах жители и сегодня обсуждают насущные проблемы на сайтах, в чатах, мессенджерах. Никаких новых законов для этого не требуется. С помощью электронной площадки должно быть налажено эффективное общение с УК, Фондом капитального ремонта. Можно будет отследить в онлайн-режиме всё, что происходит в доме: ведутся ли аварийные работы, текущий ремонт и т. д. Если я живу на 4-м этаже, а у соседа на 10-м протекла крыша, то я, как ответственный собственник, должен об этом знать. Управление собственностью не заканчивается стенами квартиры, оно касается и многого другого — чердаков, лифтов, лестниц.
Площадка должна предоставить возможность проголосовать в электронном формате по тому или иному решению. Необходимо дополнить статью 47.1 Жилищного кодекса РФ пунктом о том, что помимо очного, очно-заочного и заочного голосования у жильцов есть право проводить и виртуальное голосование.
